Terms & Conditions (AGB)

1. Scope

These Terms and Conditions apply to all orders placed through our online shop by consumers and business customers. A consumer is any natural person who enters into the transaction for purposes predominantly outside their trade, business, or profession.

2. Contracting party

The contract is concluded with:
[Company or full name]
[Street and house number]
[Postal code and city], Germany
Email: [Email address]

3. Formation of the contract

The presentation of products in the online shop does not constitute a binding offer. By clicking the order button (“Buy now” / “Order with obligation to pay”), you submit a binding offer to purchase the items in your cart. We may accept your offer by sending an order confirmation or by dispatching the goods. An automatic acknowledgement of receipt does not yet constitute acceptance.

4. Prices and shipping costs

All prices are total prices stated in euros (€).

  • If VAT-registered: prices include the applicable statutory value-added tax.
  • If small business (§ 19 UStG): in accordance with § 19 (1) UStG, no value-added tax is charged or shown.

Any shipping costs are shown separately in the cart and before you complete the order. [Describe your shipping rules, e.g. “Free shipping on orders over €39; otherwise €[amount].”]

5. Payment

The payment methods available to you are shown during checkout. [List your payment methods.] Payment is due upon conclusion of the contract unless a different due date is stated for the chosen method.

6. Delivery

We deliver to [state your delivery area, e.g. Germany and the EU]. The expected delivery time is [e.g. 1–3 business days] unless stated otherwise on the product page. If a product is temporarily unavailable, we will inform you without undue delay.

7. Retention of title

The goods remain our property until full payment has been received.

8. Right of withdrawal

Consumers have a statutory right of withdrawal as described in detail in our separate Right of Withdrawal (Cancellation Policy), which forms part of these Terms.

9. Warranty / liability for defects

The statutory rights regarding defects apply. If the goods are defective, you are entitled to the statutory remedies. Please report any transport damage where possible — this helps us process claims, but is not a condition of your statutory rights.

10. Dispute resolution

We are neither willing nor obliged to take part in dispute resolution proceedings before a consumer arbitration board.

11. Final provisions

The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods; mandatory consumer-protection provisions of the consumer’s country of residence remain unaffected. Should individual provisions be or become invalid, the validity of the remaining provisions is not affected.

Template with placeholders, not legal advice. Terms carry a real risk of Abmahnung in Germany if incorrect. Complete the bracketed sections and have the text reviewed by a lawyer or specialised service. Provide a German-language version if you sell to consumers in Germany.
